De Facto separations can be complicated, but we’re here to help

If you’ve never been married but still want your separation heard by the Family Courts we can help. When it comes to separation, the Family Law Act doesn’t discriminate between same-sex and opposite-sex couples, (or married and de facto couples) and neither do we. We’ll help you settle your matter and move on as smoothly as possible, whatever your situation.

Why Would You Need A Lawyer?

  • With over 12-years experience, there’s almost nothing we haven’t seen

When separating, it’s important to have experience on your side. Because of what we’ve seen in the past, it’s unlikely that your ex-partner will be able to ‘get one’ past us. We’ll keep you up to date with everything that’s happening in your matter so you’ll always feel in control. We want to ensure a great outcome for you and your family.

  • We give you (and your children) the best chance of a good outcome

Separating is never easy, but finalising the property and children’s arrangements is a lot easier with us on your side. We’ll guide you through everything so you can move on with your life as soon as possible.

Transparent Fixed Fees For Peace Of Mind

We offer a fixed fee model meaning you pay for the work that’s done, not for how long it takes to do the work. You’ll know exactly what you will pay as you go, with no nasty surprise bills.

Is My Relationship Recognised?

The Family Law Act recognises De Facto couples as two people (of either sex) who had a genuine domestic relationship that fits into one of these criteria:

  1. Lived together for at least 2 years
  2. There was a child of the relationship
  3. That it was registered under a prescribed law of a State or Territory
  4. Or that significant financial considerations exist

Even if you don’t fit into one of these criteria we could still help – if you think you need some advice about anything please get in touch and we’ll show you the way forward.

  • Can I Get Help With A Property Settlement?

As long as your de facto relationship is recognised by the Family Law Act, your property can be divided in the same way as it is for married couples. We’ll help you work out how much you are entitled to and do what we can to see that the settlement is as fair as possible.

  • If You Need Help To Resolve Your Parenting Matters, We’ll Be There

Although many couples can reach parenting arrangements without any help, sometimes there’s a need for a professional to step in. We can give you advice even if you’re going through family mediation – so you know your rights and when to seek more help. We’ll help you reach a solution that’s in your children’s best interests, fast.

  • Some Things May Be Different Than If You Were Married

Many things are the same, but there are some issues that pop up more frequently with de facto separations. Our lawyers are experts in de facto matters, and can help whether there are issues with children’s surnames, their passports and overseas travel, or complicated property settlements.
